Terms of service

Last updated: October 3, 2026.

These are the terms between you and Curtis Caudill, doing business as Nightcapers, Greensboro, North Carolina (“Nightcapers”) for using nightcapers.com, app.nightcapers.com, and any kit you buy. By buying a kit you agree to them.

What you are buying

A kit is a set of files written for one party: yours. You pay once, $24.99, and the kit is yours to keep. Each kit includes one free rewrite.

Your license

The license is personal and non-commercial. You may print the kit, send it to your guests, and use it for your own party.

You may not sell the files, give them away, or post them where others can download them.

If you run parties for a bar, a venue, a company, or paying guests, you need the commercial license. Write to hello@nightcapers.com.

Refunds

If your kit has an error that keeps the mystery from being solved, or the files won’t print, tell us within seven days and we’ll replace it or refund you. No refunds after the party date.

Acceptable use

You may not use Nightcapers to write about a real person in a way that targets them. Our guardrails are these: a character may carry a guest’s first name; nothing is written about a real person’s health, family, money, sexuality, religion, immigration status, or past relationships; your no-go list is honored.

We may refuse to write a kit, or remove one, that breaks this.

How a kit is written

A kit is written by software, which includes a language model, from the answers you give.

We may refuse what you submit, or change it, before a kit is written from it.

The text of a kit may contain errors. Read it before your party.

The characters are fiction. Nothing in a kit is a statement about a real person, even where a character carries a guest’s first name.

You see a preview before you pay. Reviewing it is your part. Pay only when you have.

We may refuse to write a kit, and we may remove content from one.

Who owns what

You may use your kit freely for your party. Nightcapers keeps the rights to its templates, its designs, and its brand.

Chip-ins

If you ask your guests to chip in for dinner, that is between you and them. Nightcapers is not a party to it. We do not collect, hold, or refund that money.

Filming

If you film your party, you are responsible for telling your guests and for their consent. Before you send us a video you confirm this:

I confirm that every person visible or audible in this video was told about filming and agreed to appear, that no one under 18 appears without a parent’s consent, and that I will tell Nightcapers immediately if anyone withdraws consent.

What you are responsible for

You know your guests. We don’t. You are responsible for reading the whole kit before you use it, and for deciding whether it is right for your table. You are responsible for the food and drink you serve, including allergies and diets, for who you invite, for alcohol, for the safety of your home, and for the consent of anyone you film. If someone makes a claim against Nightcapers because of your party, the people at it, the food, the filming, or what you told us about your guests, you agree to cover that claim and the cost of answering it.

Recipes, menus and grocery lists are general suggestions. They are not written for any guest’s allergy, intolerance or diet, and they may be incomplete or contain errors. Before you shop or cook, you check every ingredient and every label against your guests’ needs. Serving the food is your decision.

Warranty

We promise that your kit is written for your guest list, passes our fairness checks, and prints on a home printer. Beyond that, the kit is provided as is. We do not promise that every guest will enjoy it, that it suits every group, or that it is free of errors. If your kit has an error that keeps the mystery from being solved, or the files will not print, tell us within seven days and we will replace it or refund you.

Limit on what we owe

If something goes wrong, the most we owe you for any kit is the price you paid for it. We are not responsible for what happens at your party: the food, the drinks, the guests, filming, or anything that follows from how the kit is used. This limit applies as far as North Carolina law allows.

Governing law

These terms are governed by the laws of North Carolina.

Changes to these terms

If these terms change in a way that matters, we say so at the top of this page and email the hosts with an account.
